In the alleged rape case at the Indian Institute of Management (IIM) Calcutta’s Joka campus, second-year student Parmanand Jain, who was arrested on Friday, is preparing to file a fresh bail petition. His legal team is expected to cite two key points — the absence of medical examination of the victim and a statement by the victim’s father denying any incident of rape — as the basis for the plea in Alipore court.
The case began on Friday when a complaint was registered at Haridevpur Police Station, alleging that a female student had been drugged and sexually assaulted within the IIM Calcutta campus. Following this, Jain was arrested. According to sources, the same night around 9:34 p.m., the victim’s father received information that his daughter had fallen from an auto and was found unconscious. He later learned that the police had taken her to the hospital. He stated, “There was no atrocity or rape; my daughter fell from an auto and fainted.”
Police officials confirmed that despite the registration of a rape complaint on Friday, no medical or forensic test of the victim had been conducted by Sunday. As per procedure, such examinations require the victim’s explicit written consent, which has not yet been received. Investigating officers said medical and forensic evidence is crucial to confirm injuries or any signs of sexual assault, and the investigation cannot proceed further on these grounds without her cooperation.
With no medical examination conducted and the father’s denial of the alleged crime, the defence counsel is preparing to argue that police custody of the accused is unjustified. The legal team is likely to question the grounds of arrest in the absence of the victim’s consent for examination and any immediate medical proof. The matter is expected to be heard in Alipore court during the upcoming proceedings.
